I don't leave my dogs outside alone at all ever! We live in a wonderful neighborhood and my dogs are good dogs. They never bother the fence. I still would not do it.
You are having difficulties with keeping your dog in - it is a tragedy waiting to happen IMHO. Any dog can bite in a bad situation and then you would be looking at a liability claim. If you were not there watching, you have no way of proving what did or did not happen.
Call me cautious, leaving a dog loose in the yard is just something I would NEVER do. My neighbors like us for a reason - they are NEVER bothered by our dogs.
