Jail for L.A. Man in Doberman Cruelty Case

That just turned my stomach and made me cry. Where do these people come from? I was just going to say that I will go and rescue her, but I see she found a home.
Why do people get animals if their not going to take of them?
A pet is extend family member. Right?
Unfortunately some people are just plain bad. It is very sad to see animals suffer at the hand of the "humans" that are suppose to car for them. I'm glad she found a home - hopefully she'll have a long happy life.

The animal cruelty laws in the state of CA are woefully inadequate. The MAXIMUM penalty for the most heinous acts you can imagine, prosecuted at the felony level, is one year in a county jail..not even in a prison. This was prosecuted as a misdemeanor, and if you understood how difficult it is to get convictions, you'd actually be surprised he got 45 days..although I agree, he *should* have gotten more time.

See, DA's and judges generally don't attach too much importance to cruelty cases. It's very, very difficult to get a DA to even prosecute them, and even when they are prosecuted, many times the person just gets a slap on the hand, rather than any jail time.

For this reason, a lot of the time Animal Control agencies just make a deal with the person being accused..if they surrender the animals, AC won't pursue any complaint against them. Since most people don't know they'll probably walk away basically unharmed if they get charged and go to trial, they get bluffed into taking these deals. Definitely not a best case scenario, but at least the animals are out of harm's way.

I saw this happen many, many times when I worked at our local shelter, where animals were abused far more seriously than this, and the people walked. So it's actually surprising to me he got as MUCH time as he did, and even more surprising that part of the ruling was he couldn't own any other animals for 3 years.

Wow, I did not know the laws here were so lenient. Why is that? I know Schwarzenneger passed an animal rights law recently but why do judges and DA's not take cruelty cases seriously? Is the court system too inundated with cases?

I hope this guy was as defenseless in the L.A. County Jail as his poor dog was with him.

I'm sure the overloaded case loads have something to do with it. But it was explained to me a HUGE factor was politics..DA's like having a high percentage of convictions, and it's very difficult to win cruelty cases. They also like more high profile cases that will bring them lots of fame and glory.
Poor Poor baby girl. So so sad. I was glad to read she had been adopted......maybe now she can learn that there are nice caring people in this world......people just like us on this forum.
