I wouldn't throw more good money after bad. A person leaves a deposit because they are asking the breeder to "save" a puppy for them. The breeder no doubt turns away people as they believe this person will be taking this puppy because they left a deposit. If the person decides to change their mind, even for good reason, that deposit wouldn't be refundable. The breeder could have provided the puppy he wanted and now this pup will be looking for a new home.
You may not agree with the breeder's practices, but the law is the same for everyone.
And besides, what would be the point of asking for or providing a deposit then? It has to serve a purpose, and in this case, Mr. Ryan has even offered to hold the deposit open for a year. I would suspect this isn't something he has to do, but in a small claims court action, that sure would look good on him doing so.
Small claims may be a cheap way to go, but you still need to collect on that judgment, if you get it, and I would bet my last dollar this one isn't one you will win.
Take it as a lesson learned for $500 bucks and move on.
